Onboarding an employee from United States in the UAE (2026 employer guide)

The single biggest trap when onboarding a US hire into the UAE is the apostille myth. The United States is a Hague Apostille Convention member, but the UAE is not - so a US degree or FBI police check CANNOT travel on an apostille alone. Every US document must go through full consular legalisation: US state certification (where applicable) → US Department of State authentication → UAE Embassy in Washington DC (via VFS Global) → MOFAIC attestation inside the UAE. An apostille-only document will be rejected.

What's different

  • APOSTILLE DOES NOT WORK FOR THE UAE. US notaries and apostille services routinely offer an apostille (the US has been a Hague member since 1981), but because the UAE has not acceded to the Convention, the apostille is not accepted on its own. US documents need the older chain-legalisation route ending at the UAE Embassy in Washington DC, then MOFAIC. Instruct the hire to ask specifically for 'UAE embassy legalisation', not 'apostille'.
  • Degree chain (US-specific order): the diploma is authenticated at the state level first - typically the Secretary of State of the issuing state (some states require a county clerk or notary step before that, so the exact prerequisite varies state by state) - then by the US Department of State's Office of Authentications in Washington DC, then legalised by the UAE Embassy DC, and finally attested by UAE MOFAIC (now digital via the MOFAIC portal / UAE Pass).
  • FBI police clearance is a FEDERAL document, so it skips the state step. The 'FBI Identity History Summary' (also called an Identity History Summary Check or informally a 'rap sheet') is issued by the FBI's CJIS Division in Clarksburg, West Virginia, from a fingerprint search (FD-258 card). It goes straight to the US Department of State for authentication, then the UAE Embassy DC, then MOFAIC - it cannot be certified by a state Secretary of State. Using an FBI-approved Channeler speeds up issuance considerably.
  • The UAE Embassy in Washington DC does NOT take walk-ins - all legalisation is handled through VFS Global as the embassy's official service provider, with a typical 7–15 business-day turnaround before the document even reaches MOFAIC. Build this US-side lead time into the offer-to-start timeline; it is longer and less predictable than for apostille-only destinations.
  • US degree recognition hinges on regional accreditation. US universities are accredited by regional bodies rather than a single national ministry, so MOHRE/MOFAIC recognition depends on the institution being accredited by a recognised US regional accreditor. Online or distance-learning US degrees are accepted only where the awarding institution is properly accredited and the programme is a genuine recognised award - unaccredited or diploma-mill credentials are rejected.
  • Ministry of Education (MOHESR) equivalency is usually NOT required for standard private-sector work permits - an attested, legally-translated degree is normally enough. Equivalency becomes mandatory mainly for government roles, the Golden Visa professional track, and regulated professions (healthcare with DHA/DOH/MOHAP, engineering, education/KHDA).
