Onboarding an employee from Indonesia in the UAE (2026 employer guide)
Indonesia joined the Hague Apostille Convention (in force 4 June 2022), but the UAE has NOT - so an Indonesian apostille is NOT accepted for UAE use. Documents for an Indonesian hire (degree, police clearance) still need the full consular-legalisation chain: legalisation by Indonesia's Ministry of Foreign Affairs (Kemlu), then the UAE Embassy in Jakarta, then UAE MOFAIC after arrival. The police-clearance certificate is the SKCK, issued by the Indonesian National Police (POLRI).
What's different
- APOSTILLE TRAP - this is the single biggest Indonesia-specific pitfall. Indonesia is a full Apostille Convention member (entry into force 4 June 2022; competent authority = Ministry of Law/Kemenkumham). Because the UAE is NOT a party to the Apostille Convention (it does not appear in the HCCH status table), an apostille is worthless for UAE onboarding. Do not let a candidate or agent obtain an apostille and assume the UAE will accept it - they must instead use old-style consular legalisation.
- Governing legalisation chain for Indonesian documents used in the UAE: (1) document issued/notarised in Indonesia; (2) legalised by the Indonesian Ministry of Foreign Affairs (Kementerian Luar Negeri / Kemlu); (3) legalised by the UAE Embassy in Jakarta; (4) final attestation by UAE MOFAIC once in the UAE. This is the same non-Hague route used for Qatar, Saudi and Kuwait.
- Police clearance = SKCK (Surat Keterangan Catatan Kepolisian), issued by the Indonesian National Police (POLRI). For overseas/employment use it is obtained at national-HQ level (Mabes POLRI) with an English translation; validity is short (6 months from issue), so time its issue close to visa processing. It must run through the same Kemlu + UAE-Embassy legalisation chain - an apostilled SKCK will be rejected by the UAE.
- Migrant-worker governance is centralised and strict. Overseas placement is regulated by KP2MI (the Ministry for the Protection of Indonesian Migrant Workers, formerly BP2MI) under Presidential Regulation 130/2024; formal-sector workers are generally placed through licensed P3MI recruitment agencies, not informally. Employers should insist the paper trail runs through this official channel.
- Domestic-worker route specifically: Indonesia's 2015 moratorium banned domestic-worker deployment to roughly 19–21 Middle Eastern countries, the UAE among them. In March 2025 President Prabowo lifted it for SAUDI ARABIA ONLY; as of mid-2025 the moratorium REMAINS IN PLACE for the other Middle Eastern destinations, including the UAE. An Indonesian domestic-worker hire into the UAE may therefore still be blocked on the Indonesian side - do not assume the Saudi reopening extends to the UAE. If hiring an Indonesian domestic worker, confirm the current placement rules with the Indonesian authorities before committing.
